　　On the Theoretical Basis and System Innovation of
　　the Protection of Social Right

　　Abstract： The Protection of social right is the inevitable demand of the rule by law. The ethical and social right is the metaphysical theoretical basis of protection of social right. Maintaining social stability and protecting the welfare and bracing up civil right are the utilitarian basis of the protection of social right. In future we should have the development of rule by law as the key point of protection of social right and follow four measures such as equality， legality， judiciary and socialization in order to create pattern of protection of social right. Equality means “positive protection” instead of “inversed welfare”； legality means turning from “governmental check” to “state duty”； judiciary means government should change from “self-restriction” to “right relief”； socialization means turning from “administration undertaking everything” to “cooperative management”.
